CHAPTER 7 & CHAPTER 13 BANKRUPTCY SERVICES / DEBT RELIEF

Don't worry, it's not "just you":

If you are concerned about your current financial situation, contact Wine Country Family Law & Bankruptcy Office for a free initial consultation. Dealing with financial difficulties can cause stress and worry in your life. You may feel like you are in over your head and don't know where to turn. At Wine Country Family Law & Bankruptcy Office, we can help you get back your peace of mind. Bankruptcy attorney Lindsay R. Smith can answer the questions that you may have about Chapter 7 bankruptcy and Chapter 13 bankruptcy. Today many people face money problems due to the high price of mortgages, transportation, and every day living expenses. Often our clients turn to us after experiencing sudden life changing events such as job loss, failure of a business, illness, injury, divorce or death of a spouse. You are not alone. It is common these days to get behind on monthly payments at some point or have major credit card debt that is out of control due to skyrocketing interest rates and penalties. Even home foreclosures and short sales are now commonplace. If you need some help making your ends meets, exploring the options of debt relief or debt re-organization that are available under consumer bankruptcy laws may be the right path to get you back on track.

After consulting with Wine Country Family Law & Bankruptcy Office, you will see that bankruptcy is a very powerful debt relief device. Some of the relief it provides:

  • Stops all collections calls and harassments
  • Stops all collection activity
  • Stops wage and paycheck garnishment
  • Stops repossession of personal property such as your car
  • Can be used to postpone and stop a scheduled foreclosure on your home
  • May wipe out 2nd mortgages on under-secured homes
  • Allows you to catch up on your late mortgage payments
  • Eliminates all or most of your debts
  • Gives you a fresh start

Personal care and attention that you deserve at a cost that you can afford:

The recent wave of bankruptcies have brought about volume bankruptcy law firms with attorneys who find it a burden to pick up calls from clients. They "sell" bankruptcy instead of being a source of honest legal advice in your difficult financial time. Wine Country Family Law & Bankruptcy Office is different from many of the other bankruptcy law firms out there. We strive to provide a high degree of service and personal care to each of our clients. From start-to-finish, all of our client's cases are personally handled by our bankruptcy attorney, Lindsay R. Smith, not paralegals or assistants. This ensures your case gets the highest quality of care and attention. Our philosophy is simple: provide competent and high quality bankruptcy services at a reasonably low cost. Although legal services aren't cheap, our flat rate services are typically much lower than other Santa Rosa, Petaluma, Ukiah, Lakeport, Fort Bragg, and Novato bankruptcy law firms. Our clients know up front exactly how much they will pay and do not have to worry about steadily increasing legal bills. Unlike many North Bay bankruptcy law firms, we do not require all fees to be paid at the outset of your case. We always provide free initial consultations and we'll take the time to sit down with you, answer your questions, evaluate your situation and give you your options.

Making the decision to file (or not to file) bankruptcy:

Some bankruptcy attorneys will only spend a cursory fifteen minutes or so with you to tell you whether or not you qualify for bankruptcy. Our office is different. Filing bankruptcy is a major decision to make. Wine Country Family Law & Bankruptcy Office strongly believes that the decision to file bankruptcy should not be made based upon a brief ten or fifteen minute discussion. We feel that it is important to educate our clients regarding the various chapters of bankruptcy available, how the process works, the ramifications of filing bankruptcy, and some “do’s and don’ts” when considering filing bankruptcy. Our office spends an average of forty-five to sixty minutes on each consultation completely free of charge. Attorney Lindsay Smith takes special care to ensure that bankruptcy is explained in a straight forward and down-to-earth fashion. We want our clients to be educated and informed regarding their options so that they feel confident in their decision to file bankruptcy (or not to file). Even if filing bankruptcy does not appear to be your best option, we will tell you so and explain why. Bankruptcy lawyer Lindsay Smith is also happy to answer any questions that arise after your initial consultation at no cost.

Let us relieve some of your stress:

Attorney Lindsay R. Smith will deal with all of your creditors from the moment she becomes your attorney, relieving unnecessary stress from your life. Wine Country Family Law & Bankruptcy Office also uses the latest technology so that the process of obtaining information from our clients is quick and easy. Instead of burdening our clients with the typical two inch thick packet of paperwork to fill out utilized by most bankruptcy attorneys, we provide our clients with a simple on-line interview system. Of course, a client may always opt to receive the paperwork to fill out, if they prefer. We also use an automated credit reporting system in order to obtain your credit report. This system automatically transfers all of your credit report information into our secure computer system so that you don’t have to.

File bankruptcy from the convenience of your home!

In order to minimize the disruption on our client’s work and family schedule, we will not require multiple trips to our offices. Our initial consultation can take place by phone or in our Santa Rosa or Cloverdale office. We only prefer to meet with our clients at least one time in order to review and sign their final documents to be filed with the Court. However, our clients are welcome to call us to make an office appointment anytime they want to come in. Wine Country Family Law & Bankruptcy Office is fortunate to have clients come to us from all over the North Bay. We serve clients in Fort Bragg, Willits, Laytonville, Covelo, Napa, Calistoga, Hidden Valley, Clearlake, Kelseyville, Windsor, Healdsburg, Guerneville, Sebastopol, Rohnert Park, Petaluma, and San Rafeal, to name a few. Since Wine Country Family Law & Bankruptcy Office serves such a broad geographical area, we understand that it may be inconvenient to drive to our Cloverdale or Santa Rosa office. We are also aware that many of our clients are disabled or have other transportation issues. Therefore, attorney Lindsay Smith is more than happy to review final documents with our clients over the phone, when necessary. Once our clients signed documents are received in our office (by fax, e-mail, or mail), we then file the bankruptcy case with the Courts without our clients ever leaving home! In this situation, our clients will usually only need to travel one time during their entire bankruptcy case (to attend their mandatory Meeting of Creditors in Santa Rosa).

We invite you to compare our low fees and personalized services to those offered by other Chapter 7 and Chapter 13 bankruptcy offices in Sonoma, Mendocino, Lake, Marin, Napa, Humboldt, and Del Norte Counties.
