FAMILY LAW SERVICE OPTIONS
Wine Country Family Law & Bankruptcy Office offers a variety of services designed to meet your specific legal needs. Whether you need an attorney to handle your entire case or you simply need help with the paperwork, we can assist you while fitting within your budget.
Full Service Legal Representation
- Includes a free one-half hour initial consultation for all new family law clients.
- Full Service Legal Representation includes Lindsay R. Smith as your "Attorney of Record." Your attorney represents you in court hearings. Telephone calls, e-mails, and correspondence regarding your case are handled by your attorney. Opposing attorneys are prohibited from communicating with you directly unless your attorney is present or consents.
- All legal documents are prepared by an attorney--not a paralegal or legal assistant.
- Includes unlimited legal advice (billed at attorney's hourly rate).
Deposit required. Similar to a rental deposit on a home, this deposit remains in the attorney's client trust fund bank account until your case is complete. Meanwhile, you are billed monthly. Payment is due within twenty days of the bill. If any amount is left unpaid at the conclusion of your case, it will be deducted from your deposit. Your remaining deposit will then be returned to you.
Flat-Fee, No Deposit, No Retainer, Uncontested Divorce
- Includes a free one-half hour initial consultation for all new family law clients.
- Parties must agree in advance on all issues including division of assets and debts, child custody and support (if applicable), and spousal support.
- You are self-represented ("In Pro Per"). Lindsay R. Smith is not your "Attorney of Record" (see above). If issues become contested and/or a court appearance is necessary, your service option must be converted to full service legal representation.
- All legal document preparation is completed by an attorney--not a paralegal or legal assistant.
- Includes legal advice/consulting of up to one hour cumulatively (in addition to the free one-half hour initial consultation).
One-half of the flat-fee is due upon initiation of services. The remaining one-half is due prior to preparation of the Marital Settlement Agreement/Judgment. The flat-fee charged is based upon the factors involved in your divorce. A base flat-fee is charged for all flat-fee divorces. If your divorce involves no children, no community property rights to a home, no pensions/retirements/401(k) accounts, etc to divide, and no spousal support, you will only be charged the base flat-fee. The flat-fee increases for divorces involving children, spousal support, pensions/retirements, etc. to divide, and home(s) to divide. The flat-fee does not include court filing fees or fees for process servers. Contact our office for further fee information.
Document Preparation Only Services
- Includes a free one-half hour initial consultation for all new family law clients.
- You provide all pertinent information/data. Our attorney or qualified paralegal will complete the necessary legal documents.
- You are self-represented ("In Pro Per"). Lindsay R. Smith is not your "Attorney of Record" (see above).
- Does not include legal advice/consulting beyond the free one-half hour initial consultation.
- Our office can file the documents with the courts, upon your request. Our office can also arrange to serve the documents on the other party and complete and file the Proof of Service document, upon your request. Fees for process servers and court filing fees are additional and must be paid in advance.
Billed at Paralegal hourly rate, one hour minimum fee. Fee for first one hour due upon initiation of services. Remaining balance due upon delivery of completed documents.
Limited Scope Representation/One-Time Only Court Appearances
- If you are representing yourself in a divorce, custody, visitation, child or spousal support matter but prefer to have an attorney represent you in court, Lindsay R. Smith can appear for you on a limited scope basis/one-time only.
Small retainer fee required in advance. You will be billed at the attorney's hourly rate for preparing for the hearing and for the court appearance. The fee will be deducted from your retainer. Any additional amount due not covered by your retainer, will be billed to you and due within twenty days of the bill. Any amount remaining in your retainer will be refunded to you.
Child Support Evaluations
- Lindsay R. Smith can provide you with child support calculations and other information useful in determining whether or not to pursue a modification of your child support order. Child support evaluations are helpful when contemplating divorce or separation, as well.

Consulting Attorney
- If you are self-represented and need legal advice, Lindsay R. Smith is available to consult with you regarding your family law matters.
Fees due upon rendering of services. Fees are billed at attorney's hourly rate.
